How copyright holders submit takedown notices, how Users counter, and how we respond. Boring but necessary.
We respect the intellectual-property rights of others and ask Users of the Service to do the same. This Policy describes how copyright owners can submit notices of claimed infringement and how we respond, in accordance with the U.S. Digital Millennium Copyright Act (the "DMCA"), 17 U.S.C. § 512.
Notices of claimed copyright infringement must be sent to our Designated Agent:
dmca@cybernet.ggWe strongly prefer email notices.
To be effective under the DMCA, your notice must be in writing and include all of the following:
Misuse warning. Under the DMCA (17 U.S.C. § 512(f)), a person who knowingly misrepresents that material is infringing may be liable for damages. Submit notices in good faith.
Upon receiving a substantially compliant notice, we will:
We may share the notice (including your contact information) with the User who submitted the material so they can submit a counter-notice if appropriate.
If you are a User whose User Content was removed or disabled following a notice and you believe in good faith that the removal was the result of a mistake or misidentification, you may submit a counter-notification including:
Send counter-notifications to dmca@cybernet.gg. We will forward your counter-notification to the original complainant and may restore the material in 10-14 business days unless the complainant initiates legal action.
We will, in appropriate circumstances and in our sole discretion, terminate the Account of any User who is a repeat infringer, and we may also terminate the Hosted Servers of any Operator who is a repeat infringer or who hosts repeat-infringing User Content.
Hosted Servers may host User Content uploaded by their Operator (such as Lua resources, configuration, or assets). Operators are responsible for ensuring they have the rights to host that content. We will respond to DMCA notices targeting Operator-uploaded content as described in this Policy and may take down the content, suspend the Hosted Server, or terminate the Operator's Account in line with our repeat-infringer policy.
This Policy addresses copyright. For trademark concerns, claims under right of publicity, defamation, privacy, or other non-copyright rights, contact legal@cybernet.gg with a description of the issue and the material at issue. We will review and respond as we deem appropriate; the safe-harbor procedures of the DMCA do not apply outside copyright.
